Terms and Conditions for Website Use

These Terms govern Website use only. They do not replace or amend any merchant agreement, service agreement, data processing agreement, order form, statement of work, or other contract separately entered into with PayMaxis. If there is a conflict, the applicable signed contract prevails in relation to the services covered by that contract.

Depending on the integration and transaction flow, cardholder and other payment data may be securely transmitted, processed or routed through PayMaxis systems. PayMaxis is PCI DSS Level 1 compliant. Unless expressly agreed otherwise, PayMaxis does not act as an acquiring bank, issuing bank or deposit-taking institution, and does not hold or settle merchant or customer funds. Authorisation, acquiring, settlement and regulated payment services are performed by the applicable acquiring bank, payment service provider or other regulated payment partner.

Suspected unlawful or unauthorised activity may be investigated and, where appropriate or legally required, information may be preserved or disclosed to competent authorities, advisers, service providers or other relevant parties.

Nothing on the Website constitutes legal, regulatory, tax, financial, investment or other professional advice. References to products, payment methods, jurisdictions, licences, partners or capabilities do not constitute a commitment to provide any particular service to any person or business.

PayMaxis may modify, suspend, withdraw or restrict any part of the Website at any time. We may update Website content, product descriptions and these Terms to reflect changes to our business, technology, legal obligations or operational requirements.

You may view and make reasonable internal-use copies of publicly available Website content. No other reproduction, distribution, modification, republication, commercial exploitation, reverse engineering or creation of derivative works is permitted without PayMaxis’s prior written consent, except to the extent such restriction is prohibited by law.

The Website may contain links to third-party websites, platforms or services. Those links are provided for convenience only. PayMaxis does not control and is not responsible for third-party content, security, availability, privacy practices or terms. Access to third-party services is at your own risk and subject to the relevant third party’s terms.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, or any other liability that applicable law requires to remain unrestricted.

Personal data collected through or in connection with the Website is handled in accordance with the PayMaxis Privacy Policy. Cookies and similar technologies are handled in accordance with the PayMaxis Cookies Policy and the choices made through the Website cookie settings interface.

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Republic of Cyprus. Subject to any mandatory rights that cannot lawfully be excluded, the courts of the Republic of Cyprus shall have jurisdiction over disputes arising out of or in connection with these Terms or use of the Website.

We may amend these Terms from time to time. The updated version will be published on the Website with a revised effective date. Continued use of the Website after an update constitutes use subject to the then-current Terms.
